Civil Penalties Increasing for 2024 FLSA and FMLA Violations

The U.S. Department of Labor (DOL) has recently announced updates to the civil penalties for various violations of federal labor laws, including specific breaches of the Fair Labor Standards Act (FLSA) and the Family Medical Leave Act (FMLA). IRS Updates Application for Employer Identification Number

The IRS has recently updated Form SS-4, the Application for Employer Identification Number, with a revised date of December 2023. This form is essential for employers who have not yet been assigned an EIN.

It is a necessary step for every employer that pays wages subject to federal withholding tax and/or FICA taxes to have an EIN in order to file with the IRS or the SSA. By obtaining an EIN, the employer ensures that all deposits made are correctly credited to their account.

IRS Issues 2024 Form W-4S

The IRS has released the updated 2024 version of Form W-4S, which is used to request federal income tax withholding from sick pay.

In cases where an employee receives sick pay from a third party, such as an insurance company that is not affiliated with the employer, federal income tax will only be withheld if the employee opts for it. To initiate this process, the employee is required to submit Form W-4S to the third-party payer, who will then withhold taxes based on the employee's instructions.
